Terms & Conditions

Please read these terms and conditions carefully before completing your booking. By completing a booking with me you will have entered into a binding contract on the basis of these terms and conditions. If you have any questions about them please do not hesitate to contact me.

1. Definitions
a. The Embodiment Coaching Academy© refers to Susie Heath trading as Susie Heath, Ty Deryn, Llandogo, Monmouth NP25 4TL
b. The “client” refers to the person registered with  “The Embodiment Coaching Academy©”.
c. “The Embodiment Coaching Academy©”, “course”, “program”, “event” or “retreat” refers to The Embodiment Coaching Academy© and its online program and retreats 2023-2024
d. “Start date” means the first day of the online program retreat (i.e. the 8th September 2023)
e. “Fee” means the total cost of the year-long program.

2. Agreement: arises upon the fulfilment of the following:
a. Receipt by The Embodiment Coaching Academy© of a completed booking notification accompanied by a payment of full fees or a deposit
b. Clearance of the payment or deposit into The Embodiment Coaching Academy© bank account (or other specified account).
c. Acceptance by The Embodiment Coaching Academy© via an online booking confirmation or via an email confirmation.
d. The Embodiment Coaching Academy© reserves the right, in its absolute discretion and without the need to give reasons, to refuse to accept a booking. In such circumstances no agreement arises and The Embodiment Coaching Academy© will return any payment accompanying the booking.
e. The agreement is between The Embodiment Coaching Academy© and the client and is the sole agreement between those parties. No variation of these terms and conditions shall be applicable unless agreed in writing by the The Embodiment Coaching Academy© before the start of the course.
f. The person completing the booking shall be deemed to be agreeing to these terms for him/herself and as agent for all other persons listed on the booking and warrants that he/she is appointed agent for that purpose.
g. The agreement is governed by English law.

3. Payment
A non-refundable deposit of £495 and the remaining balance will be due by the dates specified in your email communication with and/or invoice from the The Embodiment Coaching Academy©. The Embodiment Coaching Academy© reserves the right to cancel the agreement in the event that the course fees are not paid by the agreed time, pursuant to clause 4, below. Bookings made within 4 weeks of the event start date must be accompanied by payment in full, unless payment by instalments is agreed.

4. Cancellation by client
If the booking is cancelled by the client (for any reason) the following cancellation charge will arise:
a. Cancellation more than 8 weeks before the start date, the deposit of £495 is forfeited.
b. Cancellation 4-8 weeks before the start date, 50% of the fee is payable.
c. Cancellation within 4 weeks of the start date, 100% of the fee is payable.
The client acknowledges that it is reasonable for such penalties to arise given the need for the The Embodiment Coaching Academy© to make preparations and investments for the course substantially in advance of the date of the event.
d. If cancellation of attendance at the retreats is necessary due to the client developing a severe illness in the days before the retreat start date or experiencing a medical emergency the client’s place will be held open for deferral to an equivalent retreat for up to one year from the date of the original course.

5. Cancellation/alteration of course by The Embodiment Coaching Academy©.

The Programme retreats are at the mercy of natural variables, including the weather. Whilst every reasonable effort is made to deal with such contingencies there may be occasions when The Embodiment Coaching Academy©, through no fault of its own, is forced to cancel a retreat before it starts but at short notice. In these circumstances the client will be offered a retreat on a rescheduled date.

Accepting these “Terms and Conditions” implies that the client(s) accepts and understands that there are hazards involved in this kind of course, including injury, disease, loss or damage to property, inconvenience and discomfort. The outline itineraries given for each retreat must therefore be taken as an indication of what activities may be undertaken, and not as a contractual obligation on the part of The Embodiment Coaching Academy©. Changes in itinerary may be caused by local or national restrictions, weather, sickness, or other unforeseeable circumstances.

It is a fundamental condition of joining The Embodiment Coaching Academy© that the client(s) accept this flexibility, and acknowledge that delays and alterations and their results, such as inconvenience, discomfort, or disappointment, are possible: The The Embodiment Coaching Academy© will always endeavour to provide suitable alternative arrangements.
The client(s) acknowledges that information about courses provided by The Embodiment Coaching Academy© is given in the best of faith but that because of the variability of nature it may be reasonable to alter or modify a course and that in such circumstances it is not reasonable for The Embodiment Coaching Academy© to be liable for any losses consequential on such a change and that The Embodiment Coaching Academy©’s liability is limited accordingly.

The Programme is in part a social event and benefits from the presence of a critical number of persons. If The Embodiment Coaching Academy©, in its absolute discretion and without need to give reasons, determines that a critical number will not be present it reserves the right to cancel the course at short notice. In these circumstances the client will be offered the return of monies paid or the opportunity to join the course in a subsequent year.
The client acknowledges that all the circumstances in which The Embodiment Coaching Academy© may be forced to alter or cancel the course resulted from factors beyond The Embodiment Coaching Academy©’s control. In return for The Embodiment Coaching Academy©’s undertaking to give the maximum amount of notice that circumstances allow, the client accepts that The Embodiment Coaching Academy© is not liable for any losses arising as a result of cancellation or alteration.

Accommodation during the periods of the retreats is at the client’s cost, as is breakfast and evening meals, drinks, etc. Hire of the venue, food and refreshments, during the day is included in the overall cost of the programme.

6. Expectations and physical ability
The client must expect to be involved in physical activities. No previous experience is required but the client should be of good general health. Any medical conditions must be declared on the booking form which must be completed and returned on confirmation of booking. The Embodiment Coaching Academy© can take no responsibility in the event of any ailment or aggravation of ailment suffered either during or after the programme that arises from an undeclared injury or illness.

7. Code of Conduct:
The client agrees to submit to the reasonable instructions and leadership of The Embodiment Coaching Academy©. The client acknowledges that persons attending The Programme are entitled to expect a high standard of conduct and regard for personal well-being on the part of all participants.
For this reason the client accepts that The Embodiment Coaching Academy© may, in its absolute discretion and without the need to give reasons, arrange for anyone to be removed from a course, if necessary against his/her will. Circumstances in which this might occur include (without limitation) disorderly or abusive conduct; intoxication; incapacity or inability to meet the rigours of the course. In such circumstances the client will not be entitled to a refund of monies and The Embodiment Coaching Academy© will not be liable for any losses so resulting. The client will on demand reimburse The Embodiment Coaching Academy© its reasonable costs of effecting his/her removal.

8. Liability
The client(s) acknowledges that by joining the course in the host country, The Embodiment Coaching Academy©’s responsibility does not commence until the appointed meeting time. The Embodiment Coaching Academy© shall not be responsible for any additional expenses incurred by the client to meet up with the group if the client(s) does not arrive at the appointed rendezvous.
The Programme takes place in open countryside and wilderness areas which by their very nature are not absolutely free from hazard. The Embodiment Coaching Academy© makes every effort to minimise risk to clients, and instructs clients in the safe negotiation of such risk as may remain. Consequently, the client(s) acknowledges that there are circumstances in which an accident could befall a client without The Embodiment Coaching Academy© being at fault and accepts that to that extent he/she is taking part in the course at his/her own risk. The Embodiment Coaching Academy© only accepts liability for physical injury to a client(s) that is shown to result from negligence on the part of The Embodiment Coaching Academy©.
The client(s) acknowledges that other loss, damage and expense (including, without limitation, loss of money, loss or damage to clothes and possessions, losses arising on the cancellation of a booking and the expenses of delay and harm caused other than by the negligence of The Embodiment Coaching Academy©) howsoever arising is not the responsibility of The Embodiment Coaching Academy© and that The Embodiment Coaching Academy©’ liability is hereby limited.

9. Complaints
In the unlikely event that a client(s) has cause for complaint about the course, complaint should be made to a representative of The Embodiment Coaching Academy© during the event, in order that corrective action can, if necessary, be taken. The client(s) acknowledges that it is unreasonable to take no action during a course but to complain later. However, should a problem not be resolved, complaint should be made in writing within 28 days. To the extent permitted by law The Embodiment Coaching Academy© will not be liable in respect of claims first intimated later than 28 days from the close of the relevant course.

10. USER AGREEMENT This Agreement sets out the terms and conditions relating to the online content provided in the The Embodiment Coaching Academy (“the Course”) that Susie Heath (“the Course owner”) will provide to you (“the Client”).

10a. Limitations on Use of the Materials: All content and services provided by the Course belongs to the Course owner. The Course owner owns all the intellectual property rights in the content and services. The content and services provided are solely for the personal use of the User and the User shall not sub-license, distribute, sell, supply, modify, adapt, amend, incorporate, merge, or otherwise alter any content or service provided under this Agreement. The User shall not remove or replicate any logo, copyright or proprietary notices, legends, symbols, labels, watermarks, signatures or any other like marks affixed to or embedded in the content or services. The User shall not carry out any act or omission or permit any act or omission to take place that infringes or is likely to infringe any intellectual property rights owned or used by the Course owner or its licensors.

All rights reserved. No part of this course may be sold, reproduced, used with clients, distributed or transmitted in any form or by any means, including photocopying, recording or other electronic or mechanical methods without the prior written permission of the respective owners as permitted by copyright law.

10b. Use License: Permission is granted to temporarily download one copy of any downloadable materials on the Owner’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

modify or copy the materials;

use the materials for any commercial purpose, or for any public display (commercial or non-commercial);

attempt to decompile or reverse engineer any software contained on the owner’s web site;

remove any copyright or other proprietary notations from the materials; or

transfer the materials to another person or 'mirror' the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Susie Heath at any time. Upon terminating your viewing of these materials, or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

11. Changes to this agreement
When making a booking to join the course the client(s) confirms that they have read and understood all the terms and conditions above and agrees to abide by them. The Embodiment Coaching Academy© reserves the right to update the Terms & Conditions at any time, without notice.
